Subject:Resolution No. 2020-15 Declaring a Local Emergency in the City of Dinuba, California and Request for Assistance Under the California Disaster Assistance Act (LP)

RECOMMENDATION

Council to adopt Resolution No. 2020-15 ratifying a local state of emergency as declared by the City Manager acting as the designated Director of Emergency Operations for the City of Dinuba in response to COVID-19 pandemic. 
EXECUTIVE SUMMARY

The City Manager declared a local state of emergency effective March 19,2020 in response to COVID-19 (Novel Coronavirus). The declaration was issued in abundance of caution and will allow the city to access needed financial aid and resources to combat the threat of COVID-19. The City Council must ratify the declaration of a local state of emergency consistent with state law.

DISCUSSION

The novel coronavirus identified as COVID-19 has become a worldwide pandemic. It is considered by the Centers for Disease Control and Prevention (CDC) a very serious public health threat. As a result, the United States Department of Public Health and Human Services declared a public emergency beginning January 27, 2020; the Governor of the State of California declared a statewide emergency on March 4, 2020; and, the Tulare County Board of Supervisors declared a local state of emergency on March 11, 2020. 

 

Following these declarations and in abundance of caution, the City Manager acting as the Director of the City's Emergency Operations Center declared a local state of emergency effective March 19, 2020 pursuant to Dinuba Municipal Code Ch 9.14.030. The City Manager has taken several preventative measures by making changes to city operations to limit public contact to reduce the spread of the virus in the community.

 

Resolution No. 2020-15 enclosed herein as Attachment 'A' ratifies the declaration of a local emergency issued by the City Manager. As required by law, the City Council shall review the need to continue the state of emergency every thirty (30) days until this Resolution is terminated.

 

Staff hereby requests that the City Council adopt Resolution No. 2020-15 declaring a state of local emergency and authorizes the City Manager to be the Director of Emergency Operations, or his designee, for the purposes of receipt, processing, and coordination of all inquiries and requirements necessary to obtain available state and federal Assistance.

 

As required by law, the City Council shall review the need to continue the state of emergency every thirty (30) days until this Resolution is terminated.

 

A copy of Resolution No. 2020-15 will be forwarded to the Tulare County Emergency Operations Center and the State Director of the Office of Emergency Services upon its adoption.

 
FISCAL IMPACT

The aforementioned action is requested to recover eligible costs from state and federal emergency funds.
